Terms of Service

1. Agreement to these Terms

By creating an account, purchasing a plan, downloading an application, or using DWZVPN, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service. "DWZVPN," "we," "us," and "our" refer to Deeps Wave Technologies Limited, the legal operator identified on the Contact page.

2. Eligibility and geographic availability

You must be at least 18 years old, have legal capacity to enter this agreement, and be permitted to use VPN services under the laws that apply to you. If you use DWZVPN for an organization, you represent that you have authority to bind that organization.

DWZVPN is not offered in mainland China. You must not register, purchase, or access the service from mainland China or from any other location where offering or using the service is prohibited. Availability in any other country or region does not mean that every use is lawful there; you remain responsible for complying with local law.

3. Accounts and security

You must provide accurate account information and keep it current. You are responsible for protecting credentials, devices, subscription links, and activity performed through your account. Do not share credentials or exceed the device allowance for your plan. Notify support@dwzvpn.com promptly if you suspect unauthorized access.

4. The service

DWZVPN provides software and subscription-based network access intended to improve privacy and connectivity. Available locations, nodes, protocols, speeds, and application features can change as infrastructure and technical requirements evolve. We may update applications and configurations to maintain security, compatibility, and service quality.

5. Acceptable use

You must comply with applicable law and must not use DWZVPN to:

• harm, threaten, exploit, or unlawfully monitor another person;
• distribute malware, spam, phishing, deceptive content, or unwanted bulk communications;
• attack, scan, disrupt, or gain unauthorized access to systems, accounts, or networks;
• infringe intellectual-property, privacy, publicity, or other rights;
• facilitate fraud, trafficking, sexual exploitation, terrorism, or other unlawful activity;
• resell, sublicense, scrape, reverse engineer, interfere with, or circumvent technical limits of the service except where law expressly permits it; or
• use automated or excessive traffic in a way that degrades the service for others.

We may investigate suspected violations and restrict or terminate access where reasonably necessary to protect users, third parties, or our infrastructure.

6. Trials, plans, and renewals

A Trial may be granted automatically to an eligible new account. The Trial is not sold, has no cash value, may be limited by time, data, device, or feature, and may be offered only once.

Paid plans provide the duration, data allowance, device limit, and features shown before checkout. Unless the checkout page expressly states otherwise, DWZVPN plans use manual renewal and do not renew or charge automatically. When a plan expires or its allowance is exhausted, continued access requires a new purchase or another valid entitlement.

7. Prices and payment

Prices, currencies, included taxes, and any payment-provider charges are displayed before purchase. You authorize the selected payment provider to process the amount you confirm. You are responsible for applicable taxes and for providing accurate billing information. An order is complete only after payment is confirmed and the subscription entitlement is issued.

8. Cancellations and refunds

Because plans do not automatically renew, there is no recurring subscription to cancel. You can stop using the service at any time; unused access remains available until the plan expires or its allowance is exhausted, unless the account is suspended for a Terms violation. Refund eligibility and request instructions are set out in our Refund Policy, which forms part of these Terms. Mandatory consumer rights in your country remain unaffected.

9. Intellectual property and license

DWZVPN software, websites, branding, documentation, and service technology are owned by us or our licensors and are protected by applicable law. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to install and use supported applications solely to access the service. No other rights are granted.

10. Third-party services

The service may rely on or link to app stores, payment providers, hosting providers, external websites, and open-source software. Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party products or content that we do not control.

11. Suspension and termination

You may stop using DWZVPN at any time. We may suspend or terminate an account or entitlement for nonpayment, chargeback, security risk, abuse, a material breach of these Terms, or legal requirements. Where practical and lawful, we will provide notice and an opportunity to address the issue. Sections intended by their nature to survive termination, including payment, intellectual property, disclaimers, liability, and disputes, will survive.

12. Disclaimers

To the maximum extent permitted by law, DWZVPN is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that the service will bypass every network restriction or be lawful for every use or location. You are responsible for understanding and following the laws that apply to you.

13. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, business, or opportunity arising from the service. Our aggregate liability for claims relating to the service will not exceed the greater of the amount you paid to DWZVPN during the six months before the event giving rise to the claim or USD 50. These limits do not apply where liability cannot lawfully be limited.

14. Indemnity

To the extent permitted by law, you agree to defend and indemnify the DWZVPN operator and its personnel against third-party claims, losses, and reasonable costs arising from your unlawful use of the service or material breach of these Terms.

15. Governing law and disputes

These Terms and any non-contractual obligations arising out of or connected with them are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles. Subject to any mandatory consumer rights that apply to you, you and Deeps Wave Technologies Limited submit to the non-exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region. Nothing in these Terms deprives you of protections or remedies that cannot lawfully be excluded in your place of residence.

Before starting formal proceedings, you and DWZVPN agree to try in good faith for 30 days to resolve a dispute by contacting support@dwzvpn.com. This section does not prevent either party from seeking urgent injunctive relief or using rights that cannot be waived under applicable consumer law.

16. Changes to these Terms

We may update these Terms when the service, law, or business practices change. The revised version will be published at this URL with a new effective date. If a material change affects an active paid plan, we will provide reasonable additional notice when required.

17. General

These Terms, the Privacy Policy, the Refund Policy, and terms shown at checkout form the entire agreement for the service. If a provision is unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver. You may not assign this agreement without our consent; we may assign it as part of a reorganization, financing, merger, or transfer of the service.
